Terms of Service for FarSee

These Terms of Service ("Terms") govern your download, access to, and use of FarSee, also listed as Progress Photo Tracker: FarSee (the "App"). The App is developed and operated by Dharmeshkumar Pumbhadiya, India ("FarSee," "we," "us," or "our").

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App. If you obtained the App through the Apple App Store or Google Play, the applicable store terms also apply. If these Terms conflict with mandatory law or applicable store terms, the mandatory law or store terms control to the extent of the conflict.

1. Eligibility

FarSee is a general-audience productivity App and is not directed to children under 13. You must be at least 13 years old to use the App. If the law where you live requires a higher age for you to agree to these Terms, you may use FarSee only with permission from a parent or legal guardian. A parent or caregiver may use FarSee to record a child's progress, but the adult is the App user and is responsible for the content.

If you use FarSee on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

2. What FarSee does

FarSee lets you organize photos and videos into projects, set reminders, compare moments, create collages, and export progress or timelapse videos. Features may vary by device, operating system, region, App version, or purchase status.

FarSee does not provide medical, health, fitness, childcare, or professional advice. Visual changes shown by the App should not be used to diagnose a condition or make a medical decision. Consult a qualified professional when appropriate.

3. On-device storage and backups

FarSee does not currently provide a FarSee account system or cloud-media service. Projects, captions, photos, videos, thumbnails, settings, and locally created exports are generally stored on your device. We cannot normally access, recover, or remotely delete this content.

You are responsible for:

  • protecting your device and any backup or export location;
  • keeping backup copies of content you do not want to lose;
  • confirming an export before deleting its source material; and
  • removing content from destinations to which you exported, backed up, or shared it.

Device failure, operating-system changes, insufficient storage, interrupted processing, uninstalling the App, clearing App data, or incompatibility may cause content or settings to be lost. We do not guarantee that any media, project, backup, or export can be recovered.

4. License to use the App

Subject to these Terms and applicable store rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use FarSee on devices you own or control for personal or internal business purposes.

FarSee is licensed, not sold. Except where applicable law expressly permits it, you may not:

  • copy, sell, rent, lease, sublicense, distribute, or commercially exploit the App;
  • reverse engineer, decompile, disassemble, attempt to obtain source code, or create derivative works from the App;
  • bypass purchase validation, feature restrictions, security measures, or technical limits;
  • interfere with the App, its service providers, or another user's device or data; or
  • use the App in violation of applicable law or third-party rights.

Open-source components included in FarSee remain governed by their respective licenses.

5. Your content

You retain ownership of the photos, videos, audio, captions, project names, and other material you use with FarSee ("User Content"). FarSee processes User Content at your direction to provide features such as editing, comparisons, collages, backups, and exports. We do not claim ownership of your User Content or a right to use it for advertising.

You are responsible for your User Content and must have all rights and permissions needed to capture, import, edit, export, and share it. In particular, you agree not to use FarSee to create, keep, or share content that:

  • violates privacy, publicity, copyright, trademark, or other rights;
  • was captured or shared without legally required consent;
  • exploits or sexually abuses a child;
  • contains unlawful non-consensual intimate imagery;
  • is used to harass, threaten, stalk, defame, deceive, or harm another person; or
  • otherwise violates applicable law.

If you add music or other third-party material to an export, you are responsible for obtaining the necessary rights. Social networks, cloud-storage services, messaging apps, and other destinations may remove, block, or restrict exported content under their own rules.

6. Permissions and responsible use

FarSee may request access to your camera, microphone, photos, videos, storage, notifications, or alarms when needed for a feature you choose. You can manage permissions in your device settings, but some features may not work without them.

Use the camera and App only when it is safe and lawful to do so. Do not use FarSee while driving or in any situation where distraction could cause harm.

7. In-app purchases and subscriptions

FarSee may offer optional one-time purchases, subscriptions, trials, or paid features. The product, price, currency, billing period, trial terms, taxes, and included features are shown before you confirm a purchase.

Purchases made through the Apple App Store or Google Play are processed by the applicable store, not directly by us. Store billing terms and refund rules apply. We do not receive your complete payment-card details.

If a subscription is offered:

  • it renews automatically unless you cancel it through your store account before the renewal deadline shown by the store;
  • your store account will be charged for each billing period;
  • deleting FarSee does not cancel the subscription;
  • a trial may convert to a paid subscription unless cancelled before the trial ends; and
  • price changes and any required consent will be handled under applicable store rules.

You can manage or cancel a subscription in your Apple App Store or Google Play account. Refund requests should be submitted through the store that processed the purchase, subject to its rules and applicable law. If a purchase is refunded, reversed, charged back, or found invalid, access to the associated paid feature may end. Where available, "Restore Purchases" requires the same store account or another account permitted by store rules.

Nothing in these Terms limits any non-waivable cancellation, withdrawal, refund, or other consumer right you have under applicable law.

8. Analytics, crash reporting, purchases, and external services

FarSee uses third-party services such as Firebase Analytics, Firebase Crashlytics, RevenueCat, Apple platform services, and Google Play services to provide analytics, diagnose failures, manage purchases, prevent fraud, and support the App. Those providers may apply their own terms and privacy policies.

When you choose to export, back up, or share User Content, the destination you select is an external service. We do not control and are not responsible for an external service's availability, security, content, or handling of your data. You must comply with applicable third-party terms when using FarSee with another service.

9. Advertising

FarSee does not currently display third-party advertisements. A future version may introduce advertising. Before advertising-related data collection begins, we will update the Privacy Policy and provide notices, consent controls, or opt-out choices where required by law. The availability of a paid or advertising-free option, if any, will be described in the App at that time.

10. Privacy

11. Intellectual property

FarSee, including its software, design, branding, text, graphics, and other materials supplied by us, is owned by or licensed to us and is protected by applicable intellectual-property laws. These Terms do not grant you rights in the FarSee name, logo, or other branding except as necessary to use the App.

If you send suggestions or feedback, you allow us to use them without restriction or payment, but you retain ownership of any rights you may have in the feedback. Do not send confidential information as feedback.

12. Updates, availability, and changes to features

We may release updates, correct errors, add or remove features, change technical requirements, or stop supporting an older App version. Some updates may be required for security, compatibility, purchase validation, or continued operation.

We may suspend or discontinue all or part of FarSee when reasonably necessary, subject to applicable law. We do not promise that every feature will always be available, that FarSee will work on every device or operating-system version, or that exports will be compatible with every third-party service.

13. Suspension and termination

You may stop using FarSee at any time and may uninstall it. If you have a subscription, uninstalling does not cancel it; you must cancel through the applicable store.

Your license may terminate if you materially breach these Terms. Where reasonable, we will give notice and an opportunity to correct the breach, unless immediate action is needed for legal, security, fraud-prevention, or safety reasons. Upon termination, you must stop using the App. Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, liability limits, disputes, and store-specific terms—will survive.

14. Disclaimers

To the maximum extent permitted by law, FarSee is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, perfect image or video quality, precise timing or alignment, successful export, permanent compatibility, or recovery of locally stored content.

We disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement to the extent the law permits. Some jurisdictions do not allow certain exclusions, so these disclaimers may not apply to you. Any mandatory warranties and statutory consumer rights remain unaffected.

15. Limitation of liability

To the maximum extent permitted by law, neither we nor our service providers will be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for loss of data, content, profits, revenue, business, goodwill, or opportunities arising from FarSee or these Terms.

To the maximum extent permitted by law, our total liability arising from FarSee or these Terms will not exceed the greater of: (a) the amount you paid for FarSee during the 12 months before the event giving rise to the claim; or (b) USD 50.

These limitations do not apply where liability cannot legally be limited, including liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence where applicable law prohibits limitation. Your mandatory consumer rights remain unaffected.

16. Indemnity

To the extent permitted by law, you agree to defend and indemnify us against third-party claims, damages, and reasonable costs arising from your unlawful use of FarSee, your infringement of another person's rights, or User Content you export or share. This section does not require you to indemnify us for our own negligence, willful misconduct, or violation of law.

17. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Before filing a claim, you and we agree to attempt in good faith to resolve the dispute by contacting the other party and allowing 30 days for a response. You may contact us at wrongturnapps@gmail.com.

Subject to any mandatory consumer rights or forum requirements, the courts with jurisdiction in Gujarat, India will have jurisdiction over disputes relating to FarSee or these Terms. If the law where you live gives you the right to rely on local consumer law or bring a claim in your local courts, these Terms do not take away that right.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Changes to these Terms

We may update these Terms to reflect changes to FarSee, our business, store requirements, or applicable law. We will update the "Last updated" date and provide additional notice in the App or through another appropriate method when required. Material changes apply prospectively from their stated effective date.

If you do not agree to updated Terms, stop using FarSee and cancel any subscription before its next renewal. Continued use after updated Terms take effect constitutes acceptance where permitted by law.

19. General terms

If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent, but we may transfer them as part of a merger, reorganization, sale of assets, or transfer of FarSee, subject to applicable law. Headings are for convenience only.

These Terms, the Privacy Policy, applicable purchase disclosures, applicable store terms, and any mandatory legal rights form the entire agreement between you and us concerning FarSee.

20. App-store-specific terms

Apple App Store

If you obtained FarSee through Apple's App Store:

  • Apple's Licensed Application End User License Agreement (the "Apple Standard EULA") applies to your license unless Apple displays a valid custom EULA. These Terms supplement the Apple Standard EULA and do not replace or conflict with Apple's usage rules.
  • These Terms are between you and us, not Apple. We, not Apple, are responsible for FarSee and its content, maintenance, support, and claims relating to the App.
  • Apple has no duty to provide maintenance or support for FarSee. If FarSee fails to meet an applicable warranty, you may notify Apple, and Apple may refund the App's purchase price as required by its terms and applicable law. Apple has no other warranty obligation for FarSee.
  • We, not Apple, are responsible for addressing claims concerning FarSee, including product-liability, regulatory, consumer-protection, privacy, or intellectual-property claims.
  • You must comply with the Apple Media Services Terms and other applicable third-party terms. You confirm that you are not located in a country or region subject to a United States government embargo and are not on a United States government restricted-party list.
  • Apple and its subsidiaries are intended third-party beneficiaries of these Apple-specific provisions and may enforce them against you.

Google Play

If you obtained FarSee through Google Play:

  • these Terms are between you and us; Google is not responsible for operating, maintaining, or supporting FarSee;
  • your use of Google Play and store-processed purchases is also governed by the Google Play Terms of Service and applicable Google payment and refund rules; and
  • if these Terms conflict with Google Play's applicable terms concerning the store transaction, Google Play's applicable terms control for that transaction.
