Terms of use

1. Acceptance of Terms

By downloading or using Nitya (“App”), you agree to these Terms of Service (“Terms”).
If you do not agree, do not install or use the App.

2. Use of the App 

You may use Nitya only for personal, non-commercial purposes and in compliance with all applicable laws.

You agree not to:
Copy, modify, or distribute the App or its content
Attempt to decompile or reverse-engineer the App
Use the App for any harmful, illegal, or abusive purpose

3. Intellectual Property

All trademarks, logos, content, and code in Nitya are the property of the Nitya App Developer. You may not reuse or reproduce any portion of the App without prior written permission from the developer.

4. User Content 

You retain ownership of the data you create (habits, journals, routines). You are solely responsible for the accuracy and legality of that content. We are not liable for any loss resulting from device malfunction, deletion, or uninstallation.

5. Privacy 

Your privacy is protected under our Privacy Policy. By using the App, you consent to our data practices as described therein.

6. Purchases and Subscriptions 

All purchases and subscription payments are processed securely through the Apple App Store or Google Play Store. We do not collect, store, or have access to your payment information.

We use RevenueCat to manage subscriptions and entitlement status across platforms. RevenueCat processes limited purchase-related information (such as subscription status, product identifiers, and transaction events) in accordance with its privacy policy. RevenueCat does not share your payment details with us.

Refunds, cancellations, and billing disputes are governed by the policies of the Apple App Store, Google Play Store, and RevenueCat, as applicable. 

Subscription Terms and Conditions Our App offers auto-renewable subscriptions. By subscribing, you agree to the following:

  • Payment: Payment will be charged to your Apple ID (iOS) or Google Play Account (Android) at the time of purchase confirmation.

  • Automatic Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.

  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period.

  • Managing Subscriptions: You can manage and cancel your subscriptions in your Account Settings on the App Store or Google Play Store.

  • Cancellations: You may cancel your subscription at any time; however, there are no refunds for partially used periods.

  • Free Trials: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription to that publication.

  • Refunds: Refunds are handled by the platform (Apple or Google) through which the purchase was made

  • EULA: Use of the app is also governed by the Apple Standard Licensed Application End User License Agreement (for iOS users) and the Google Play Developer Distribution Agreement (for Android users). 

7. Third-Party Services 

The App may use Google Analytics and Firebase for crash reporting and analytics. Usage of these services is subject to Google’s privacy terms.

8. Termination 

We may suspend or terminate access to Nitya at any time for violations of these Terms or applicable law. You may terminate use at any time by uninstalling the App.

9. Limitation of Liability 

Nitya is provided “as is” and “as available,” without any warranties of any kind.

We are not liable for any damages arising from:
Data loss due to device failure or user action
Inaccurate statistics or analytics
Inability to access or use the App
Your sole remedy is to stop using the App.

10. Indemnification 

You agree to indemnify and hold harmless the Nitya App Developer and its affiliates from any claim, liability, or loss arising from your use of the App or violation of these Terms.

11. Governing Law 

This Privacy Policy shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the app developer is based, without regard to its conflict of law provisions.
If you are located in another region, you acknowledge that your information may be processed in accordance with this Privacy Policy, and any disputes arising under it shall be subject to the jurisdiction of competent courts as permitted under applicable laws.

12. Modifications

We may update these Terms to reflect new features or changes in law. Continued use of the App after updates constitutes acceptance of the revised Terms.
